Agreement and Scope

These Terms & Conditions (“Terms”) govern access to and use of the FuelSmart Pro and related PlaneCare websites, applications, calculators, reference tables, planners, reports, video tutorials, and related services (collectively, the “Software”) provided by PlaneCare International, LLC (“PlaneCare,” “we,” “us,” or “our”). They cover the features made available under your plan, including fuel tankering, aviation conversions, world time and ETD/ETA, Flight Mapper, CDM Planner, CORSIA and SAF tools, China RVSM tables, and crew duty, rest, and rotation planning.

By accepting these Terms or using the Software after being presented with these Terms, you agree to them. If you use the Software on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree, do not use the Software.

02

Purpose and Limitations

FuelSmart Pro provides informational estimates and reference material for fuel economics, aviation units and times, routes, departure coordination, emissions and sustainable aviation fuel, altitude references, and crew planning. Features use user inputs, reference data, calculation models, and assumptions.

The Software is not a certified flight planning tool, operational control system, dispatch release system, or substitute for approved aircraft documentation, applicable regulations, or operator procedures.

Results support preliminary analysis and familiarization only. They do not establish whether any flight, route, altitude, fuel load, tankering decision, crew assignment, rest period, or emissions claim is safe, legal, or operationally permissible.

03

Mandatory Aviation Safety Disclaimer

DO NOT USE THE SOFTWARE AS THE SOLE BASIS FOR ANY FUELING, DISPATCH, FLIGHT PLANNING, OR OTHER OPERATIONAL DECISION.

All relevant inputs and results must be independently verified using current approved Aircraft Flight Manuals (AFM), applicable supplements and limitations, appropriate flight planning systems, current official aviation information, applicable regulations, and operator procedures. The approved documents and applicable requirements take precedence over the Software.

The pilot in command, operator, dispatcher, and other responsible personnel retain their respective responsibilities under applicable law. Use of the Software does not transfer or reduce those responsibilities.

04

Aircraft Data Capacities and Reserve Defaults

Aircraft specifications and default values are reference inputs. Values may differ by model variant, serial number, equipment, configuration, modifications, documentation revision, and operating conditions.

A listed maximum fuel capacity does not mean that quantity can be carried on a particular flight. Users must independently verify usable fuel, units, fuel density, weight and balance, structural limits, aircraft performance, and all other applicable limitations.

Reserve defaults are modeling assumptions. They are not a determination of required reserves and may not satisfy the requirements of a particular flight, jurisdiction, or operation.

Users must verify and, where supported, adjust reference values before using results. If the Software cannot represent the applicable aircraft or operating conditions accurately, its results must not be relied upon.

05

Inputs Models and Results

The Software may use user-provided information, estimated performance relationships, cost-to-carry assumptions, and manual or third-party fuel prices.

You are responsible for checking inputs, including units, currencies, fuel quantities, density, prices, aircraft selection, airport identity, local and UTC dates and times, time zones, daylight-saving offsets, flight duration, crew assignments, and any manually selected limits. Defaults and automatically populated fields require verification.

Actual results may differ because of weather, routing, aircraft condition, operating techniques, fuel characteristics, pricing changes, taxes, fees, or other circumstances.

Unless expressly included in the applicable calculation, results may omit costs or constraints such as handling fees, minimum uplift requirements, payload effects, or operational restrictions.

We do not guarantee fuel savings, profitability, accuracy for a particular aircraft, or suitability for a particular operation.

06

Limitations of Individual Tools

Fuel tankering. Cost comparisons, recommended uplifts, and savings estimates do not authorize a fuel load or replace reserve, weight and balance, aircraft performance, fuel quality, or operational checks. Reference capacities and modeled cost-to-carry values must be verified for the aircraft and flight.

Flight Mapper. Displayed routes, distances, and flight durations are estimates. A displayed path is not an ATC clearance, approved navigation route, terrain or obstacle assessment, airspace authorization, or assessment of weather, NOTAMs, airport suitability, or fuel sufficiency. Automatically transferred route durations remain estimates.

Conversions, world time, and ETD/ETA. Verify source and destination units, airport codes, time-zone assignments, the departure date, local time, UTC offset, daylight-saving changes, duration format, and arrival-date changes. A timer or live clock depends on the device and browser and is not an authoritative time source. Airport data and time-zone rules may be incomplete or out of date. Arrival estimates do not account for taxi, delays, winds, or other operational factors unless expressly included.

CDM Planner. Calculated departure milestones and countdowns are planning aids. They do not submit or confirm a slot, coordinate with an airport or network authority, or replace official airport collaborative decision-making procedures, ATC instructions, clearances, or assigned departure times. Confirm current milestones through the authorized operational channels.

CORSIA and SAF. Fuel, emissions, blend, lifecycle reduction, and cost outputs are estimates based on the selected inputs and assumptions. They do not establish CORSIA eligibility, compliance, verified emissions, offset obligations, sustainability certification, credit ownership, or the right to make an environmental claim. Independently verify current requirements, eligible fuels, documentation, emissions factors, and any avoidance of double counting. These tools do not provide legal, tax, investment, or regulatory advice.

China RVSM. The feet-to-meters table is a reference aid, not an operational conversion authorization or altitude clearance. It does not establish aircraft or crew RVSM approval. Verify current official altitude assignment procedures, ATC clearances, charting, and the applicable aircraft AFM and supplements; do not substitute arithmetic rounding for an officially assigned flight level.

Crew duty and rest. The standard private/corporate FAA Part 91 planning mode does not certify compliance or fitness for duty. User-selected limits and defaults are planning assumptions, not a statement that a legal limit applies or does not apply. Do not use that mode to determine compliance under Part 91 Subpart K, Parts 117, 121 or 135, other jurisdictions, employment agreements, or operator policies. Determine the rules and fatigue controls that apply to your operation independently.

Inflight rest rotations and timers. Suggested rotations, rest windows, and countdowns do not approve augmented crew operations, establish qualifying rest, or determine minimum operating crew or fitness for duty. Confirm crew qualifications, required staffing, rest facilities, handover arrangements, and applicable procedures. Browser suspension, background operation, device sleep, a wrong device clock, or loss of power may interrupt timing or alerts. Use independent timing and crew procedures; never rely on a Software alert as the sole means of waking or relieving a crewmember.

Video tutorials. Videos, narration, captions, examples, and transcripts are software guides and familiarization material only. They are not approved operational training, checking, certification, or authorization. Examples may use illustrative values and may show an earlier interface. Follow the current approved documentation and verify the current tool behavior.

07

Manufacturer References and Independence

PlaneCare International, LLC and FuelSmart Pro are independent of aircraft manufacturers and original equipment manufacturers (OEMs). PlaneCare, FuelSmart Pro, and the individuals providing these services do not represent, act for, or act on behalf of any aircraft manufacturer or OEM, and have no authority to make commitments or representations on their behalf.

The Software and its related services are not affiliated with, sponsored by, endorsed by, certified by, or approved by any aircraft manufacturer or OEM. References to aircraft, engines, equipment, components, suppliers, or aviation authorities identify relevant products or information only; they do not imply agency, partnership, authorization, endorsement, or regulatory approval.

Manufacturer names, aircraft model names, and associated trademarks are used solely to identify aircraft referenced or supported by the Software. Those names and trademarks remain the property of their respective owners.

Listing an aircraft or equipment does not imply that its manufacturer or OEM supplied, reviewed, certified, or validated our data, formulas, assumptions, results, reference tables, videos, or other content.

08

Third Party Services and Data

The Software may depend on third-party services, including payment processors, app stores, hosting providers, and data suppliers.

Third-party information may be incomplete, delayed, inaccurate, or unavailable. Access to third-party services may be subject to their own terms and privacy policies.

To the extent permitted by law, we are not responsible for failures or inaccuracies attributable to independent third-party services. This provision does not exclude responsibilities that applicable law places on PlaneCare.

09

Accounts and Authorized Use

You must provide accurate account information, protect your login credentials, and comply with the user, device, aircraft, and other limits of your subscription.

Notify support@fuelsmart.io promptly if you suspect unauthorized account access.

You may use the Software only for lawful purposes and within your subscription or enterprise agreement. Comply with applicable export-control and sanctions laws when accessing or distributing the Software. You must not:

Share access beyond your authorized plan.

Resell access without our written permission.

Interfere with security or availability.

Access another user’s information without authorization.

Copy protected software or content, or reverse engineer the Software, except where applicable law permits.

Represent results as manufacturer-approved or certified flight planning outputs.

10

Subscriptions Billing and Renewal

Available features, prices, billing periods, and plan limits are described at checkout or in a signed enterprise agreement.

If you purchase an automatically renewing subscription, it renews for successive billing periods unless canceled before the applicable renewal deadline disclosed at purchase. By expressly agreeing to recurring billing at checkout, you authorize charges to your selected payment method at the disclosed frequency and price, plus applicable taxes.

For website purchases, use the cancellation mechanism provided in your account or billing portal. If you cannot access it, contact support@fuelsmart.io promptly for assistance.

For Apple App Store or Google Play purchases, manage and cancel the subscription through the applicable store’s subscription settings. Store billing rules and cancellation deadlines apply.

Cancellation stops future renewals once effective. Unless otherwise disclosed or required by law, access continues through the paid subscription period. Uninstalling the app does not cancel a subscription.

We will provide notices and obtain additional consent for price changes or renewals where required by applicable law or store rules.

11

Refunds and Consumer Rights

Except as required by law, expressly stated at purchase, or agreed by us in writing, fees for completed subscription periods and unused portions of a billing period are non-refundable.

Purchases through Apple or Google are also subject to the applicable store’s refund procedures and policies.

Nothing in these Terms limits mandatory refund rights, cancellation rights, statutory guarantees, or other rights that cannot lawfully be excluded.

12

Reports and Sharing

Reports and exported results are informational estimates. They are not dispatch releases, regulatory approvals, or proof of compliance.

You may use and share reports for your lawful business purposes, subject to your subscription and any enterprise agreement. Preserve material assumptions, units, dates, and safety notices when sharing results.

13

Intellectual Property and User Data

PlaneCare and its licensors retain rights in the Software and their respective original code, branding, text, designs, and other protected material.

These Terms do not claim ownership of third-party trademarks, independently existing factual information, or mathematical principles.

Subject to these Terms and payment of applicable fees, we grant you a limited, nonexclusive, nontransferable right to access and use the Software during your authorized access, including any permitted free use.

Access to tutorials permits viewing for your own familiarization or authorized internal business use. It does not grant permission to reproduce, rehost, sell, or distribute the videos, narration, captions, or transcripts, except with our written permission or where applicable law permits. Permissions for sharing your calculation reports are described in Section 12 or in your plan.

You retain any ownership rights you have in information you submit. You authorize us to process that information as necessary to provide, secure, and maintain the Software, consistent with our Privacy Policy and any applicable enterprise agreement.

14

Privacy

Our Privacy Policy explains our handling of personal information. Do not submit information you are not authorized to provide.

Any separate signed data processing agreement applies according to its terms.

15

Availability and Changes

Features and aircraft coverage may change. Maintenance, technical failures, and third-party interruptions may affect availability.

Unless a signed agreement states otherwise, we do not promise uninterrupted access or a particular service level.

If we discontinue a paid service without your breach, we will provide any refund or other remedy required by applicable law or our agreement with you.

16

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

PlaneCare disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement, to the extent those warranties may lawfully be excluded.

We do not warrant that the Software will be error-free, uninterrupted, or appropriate for every aircraft or operation.

Mandatory statutory warranties and rights remain unaffected.

17

Limitation of Liability and Aviation Specific Risks

FUELSMART PRO AND THE RELATED PLANECARE TOOLS PROVIDE INFORMATIONAL ESTIMATES AND REFERENCES. THEY DO NOT DETERMINE WHETHER A FUEL LOAD, ROUTE, ALTITUDE, DISPATCH, FLIGHT, CREW ASSIGNMENT, REST PERIOD, OR REGULATORY OR ENVIRONMENTAL CLAIM IS SAFE, LEGAL, OR PERMISSIBLE.

You are responsible for independently verifying inputs, assumptions, and results before using them in any decision. This includes aircraft configuration, usable fuel capacity, reserve requirements, units, fuel density, weight and balance, performance limitations, fuel prices, and applicable operating requirements. These responsibilities do not relieve PlaneCare of duties imposed by applicable law.

Exclusion of Certain Damages. To the maximum extent permitted by applicable law, PlaneCare International, LLC and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Software. This includes lost profits, unrealized fuel savings, business interruption, loss of data, and consequential costs associated with delays, diversions, cancellations, fuel purchases, or payload restrictions, even if advised that such damages were possible.

Calculation and Operational Claims. Subject to the exceptions below, the exclusions and liability cap in this section apply to claims arising from inaccurate or incomplete reference data, aircraft specifications, reserve or duty defaults, calculation errors, incorrect inputs, unit or time-zone conversions, date changes, route or duration estimates, outdated prices, altitude tables, emissions assumptions, rest rotations, missed timer alerts, service interruptions, tutorials, or reliance on reports or recommendations. They also apply to claims arising from fueling, tankering, dispatch, crew planning, or other operational decisions made using Software results.

Aggregate Liability Cap. To the maximum extent permitted by applicable law, the total aggregate liability of PlaneCare International, LLC and its officers, directors, employees, and agents for all claims arising from or relating to the Software or these Terms will not exceed the total fees you paid to PlaneCare, directly or through an authorized payment platform, for the Software during the 12 months immediately preceding the event giving rise to the claim.

Application to Negligence Claims. To the extent permitted by applicable law, these exclusions and limitations apply to claims based on contract, warranty, tort—including ordinary negligence—or any other legal theory. They apply even if a remedy fails of its essential purpose.

Exceptions and Mandatory Rights. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability that applicable law does not permit to be excluded or limited. This includes liability for death or personal injury to the extent such liability cannot lawfully be excluded or limited. Mandatory consumer rights and statutory remedies remain unaffected.

Allocation of Risk. The fees for the Software reflect the allocation of risk described in these Terms. This section does not authorize unsafe operations, excuse regulatory noncompliance, or transfer responsibilities imposed by aviation law.

18

Business User Indemnification

If you use the Software on behalf of a business, that business agrees, to the extent permitted by law, to indemnify PlaneCare against third-party claims and reasonable associated costs arising from its unlawful use of the Software, material breach of these Terms, or submission of information that infringes another party’s rights.

This obligation does not apply to the extent a claim results from PlaneCare’s own breach, negligence, or misconduct.

We will provide reasonable notice of a covered claim and an opportunity to participate in its defense. No settlement may impose an admission or nonmonetary obligation on the indemnifying party without its consent.

19

Suspension and Termination

We may suspend or terminate access for material violations, nonpayment, unlawful activity, or a reasonable security concern.

Where practicable, we will provide notice and an opportunity to resolve the issue. Immediate suspension may be necessary to protect users, the Software, or legal compliance.

Termination does not eliminate accrued payment obligations or rights and remedies available under applicable law. Refund eligibility remains subject to Section 11.

20

Governing Law and Disputes

These Terms are governed by Florida law, without regard to conflict-of-law principles, except where mandatory law requires otherwise.

Please first contact support@fuelsmart.io to attempt to resolve a dispute informally. Doing so does not waive your legal rights or applicable filing deadlines.

Subject to mandatory consumer protections and other applicable law, disputes will be brought in a state or federal court of competent jurisdiction in Florida. Nothing in these Terms prevents a consumer from using a court or remedy available under mandatory law.

21

Updates to These Terms

We may update these Terms prospectively. The revised version will identify its effective date.

We will provide notice of material changes and obtain renewed agreement where required by law. Changes will not retroactively alter accrued claims or charges.

If you do not accept revised Terms, stop using the Software and cancel any renewal before the applicable deadline.

22

General Provisions

A signed enterprise agreement controls over conflicting provisions of these Terms for the services it covers.

If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later.

Provisions that by their nature should survive termination—including ownership, accrued payment obligations, liability limitations, and dispute provisions—will survive.
